Message a good faith gesture that I AM buying the product and I am giving you this money as a down payment so you will not sell it while I get the other funds together.

Deposits should never be considered anything but non-refundable in my opionion unless otherwise stated.

Why take the deposit at all then? Why not just say "Hey man, I want that. Please hold it for me"

What happens to good faith money you put down on a house when you back out? Gone. Go to a dealer and give them money to hold a car and then back out. What happens to that money. Gone.

You are paying them to hold it for you. If they did, then your money is gone.

Maybe I am just a hardass, but I would sleep like a baby with that 15% in my pocket. You could have sold it long ago and had cash in hand, but you waited for them. That is the nature of deposits.
